SpreeMedia and its partners provide web hosting and web
development services to clients, and together have a
responsibility to protect each client and provide the best
services available. The following guidelines were
established by SpreeMedia to ensure the integrity of
these services.
SpreeMedia customers agree to adhere to these policies.
Content: All services may be used for lawful purposes only.
Transmission, storage, or presentation of any
information, data or material in violation of any United
States Federal, State or City law is prohibited.
This include, but is not limited to: copyrighted material,
material we judge to be threatening, obscene, demeaning
to others, or material protected by trade secret and other
statutes.
The customer agrees to indemnify and hold SpreeMedia
harmless from any claims resulting from the use of the service
which damages the subscriber or any other party.
Please Note: Pornography and sex-related merchandising
are prohibited on all our servers. This includes sites that
may infer sexual content, or contain links to adult content
elsewhere.
This is also true for sites that promote any illegal activity
or content that may be damaging to our servers or any
other server on the internet. Links to such materials are
also prohibited.
Monthly Service Charges: Customers may choose to be
billed to their credit card or sent an email invoice
(to be paid by check), monthly. If the customer chooses
the latter, payment must be received before services will be
activated or continued.
Billing becomes effective the first day of account
activation and is without exception paid 30 days in
advance. Thereafter, customers will be charged on a
recurring monthly basis.
Declined credit cards and past due payments may result
in immediate deactivation of account/s.
Cancellation of accounts can be sent to our office, via email
to or contact email address provided during account activation.
Credits are not issued for unused current month previously
billed, but we will be happy to keep your account active
through the end of the current billing cycle.
There is a $100.00 fee to restore web sites from back-up tape
if they have been suspended for nonpayment or any other
billing issue.
In addition any sites selling or promoting Bulk email
services are not allowed. Examples of non-acceptable
content or links: Pirated software Hackers programs or
archives Warez Sites Irc Bots Mp3. We will be the sole
arbiter as to what constitutes a violation of this provision.
Web Site Content Provisions: All services provided by
SpreeMedia may be used for lawful purposes only.

SpreeMedia from any claims resulting from the use of the
service which damages the subscriber or any other party.

to adult content elsewhere. SpreeMedia will be the sole
arbiter as to what constitutes a violation of this provision.
Traffic Guidelines: We are proud to offer unlimited traffic
to all our clients. Each account comes with its own cgi-bin,
and account control panel.
| You are free to use any CGI scripts you wish, however we
reserve the right to disable any CGI script that effects our
normal server operations.
Commercial Advertising - Email: Our servers may not
be the source, intermediary, or destination address
involved in the transmission of SPAM, flames, or mail
bombs. Your domain may not be referenced as the
originator, intermediary, or reply-to address in any of
the above. Advertising sites on other servers which in
turn contain links to a domain on our servers is
prohibited.
We consider spam any mass unsolicited message in the
mediums of Newsgroups and Email.
If you are found to have spammed, then we may
immediately, without warning, disable your domain.
In addition, we will impose a $100 penalty for each spam
policy violation. We reserve the right to refuse or cancel
service to known spammers. Lastly, we reserve the right
to determine what violates this policy. As such, any
violation will result in immediate deactivation of services
without refund.
Server Abuse: Any attempts to undermine or cause
harm to a server is strictly prohibited. Loss of data or
Server/domain downtime: SpreeMedia is proud of its server
speeds and reliability; however, we cannot be responsible
for advertising costs, loss of business or other damages
resulting from domain or server downtime or loss of data.
In addition, the servers are not intended to be a file
storage facility. All files should be accessible by
hyperlink to be considered of a non-storage nature.
In all cases, each customer is responsible for
maintaining a backup copy of all files maintained on the
server.
Indemnification: Customer agrees that it shall defend,
indemnify, save and hold SpreeMedia harmless from any
and all demands, liabilities, losses, costs and claims,
including, reasonable attorney fees asserted against
SpreeMedia, its agents, its customers, officers and
employees, that may arise or result from any service
provided or performed or agreed to be performed or
any product sold by customer, it's agents, employees
or assigns.
Customer agrees to defend, indemnify and hold harmless
SpreeMedia against liabilities arising out of:
(1) any injury to person or property caused by any
products sold or otherwise distributed in connection with
SpreeMedia’s server.
(2) any material supplied by customer infringing or allegedly
infringing on the proprietary rights of a third party and
(3) copyright infringement.
Refusal of Service: We reserve the right to refuse or
cancel service at our sole discretion, if any of our
hosting policies are not adhered to.
SpreeMedia will not be responsible for any damages your
business may suffer. SpreeMedia makes no warranties of
any kind, expressed or implied, for the
services we provide.
SpreeMedia disclaims any warranty or
merchantability or fitness for a particular purpose.
This includes loss of data resulting from delays, and any
and all service interruptions caused server glitches,
server errors or any technical faults caused by
SpreeMedia, its employees or third party
providers.
SpreeMedia reserves the right to change or update our
policies without notice. If any terms or conditions are
failed to be followed it will result in grounds for account
deactivation.
We reserve the right to remove any account without
notice if any terms or conditions mentioned herein are
violated. If such an occurrence takes place, the fees for
that month's hosting service will be non-refundable.
